Terms of use

These terms govern the use of AIM CREATE (www.aim-create.ai), a service operated by BIOMAG S.L.U., NIF B01037241, with registered office at Barratxi 39, Pab. 3, 01013 Vitoria-Gasteiz (Álava), España (“we”, “us”). The service, its support and these terms are provided by BIOMAG S.L.U.. Purchases are sold to you by the Merchant of Record described under “Orders and payment”. By continuing to use the service you agree to these terms.

The service

AIM CREATE is a suite of creative applications that run in your web browser: image editing, video editing, photo development, vector illustration, page layout, motion graphics, audio, technical drawing, interface design, whiteboard, digital painting, pixel art, 3D sculpting, templates, file utilities, short videos, music, 3D-printing preparation, laser and CNC cutting, type design and 3D scenes; and AIM Genera, which creates images, video, audio and 3D objects with artificial intelligence. The editors can be used for free without an account, with no watermarks on what you export. CREATE Plus is an optional paid subscription (monthly credits and the quality modes of AIM Genera, early access to new apps and priority email support, with an answer within 1 working day), and AIM Genera credit packs are optional one-off purchases, with the features and prices shown on the pricing page.

Orders and payment

Payment is made with Stripe, through Link, its payment service, which is the Merchant of Record for our orders: it takes the payment, sends you the receipt and the invoice and applies the taxes of your country. Your bank statement will show “LINK.COM* AIMCREATE”. You can view your payments, change your payment method or cancel from Link (link.com), or from your account.
Prices include VAT or the applicable sales tax, which is calculated for your country and shown before you pay.
CREATE Plus is billed every year or every 6 months, as you choose, and renews automatically at the end of each period until you cancel it. You can cancel at any time from your account: it does not renew, and you keep Plus until the end of the period already paid.
If we change a price, we will tell you in advance and the new price will apply from your next renewal. You can cancel before it does.

AIM Genera and credits

AIM Genera works with credits. You see the exact number of credits before each request and are never charged more. If a generation fails, its credits are returned automatically. Within 24 hours of receiving a result you can use “This doesn’t work for me” to get back half of what it cost, once per result and up to a limit over 30 days (10 % of the credits used in that period, at least 3).
Credits are a prepaid allowance to use AIM Genera. They have no monetary value, cannot be exchanged for money, transferred, sold or used outside AIM CREATE, and are not a currency or stored value. Free credits expire on the date shown in your balance; each month’s CREATE Plus credits are valid for 90 days from when they are added to your balance (so they add up for up to 3 months); purchased packs are valid for 12 months.
Without CREATE Plus, AIM Genera uses the Fast mode of each operation; the other modes (Quality, Cinema) are part of CREATE Plus. If you request one without Plus, nothing is charged.

Acceptable use

You must not use AIM CREATE to:

break the law or help others break it, or commit fraud, phishing or send spam;
infringe intellectual property, image, privacy or other rights of third parties;
create sexual content, any content involving minors, graphic violence, hate or harassment, or illegal material;
create deepfakes, impersonate real people, or use a person’s face or voice without their explicit consent;
interfere with the security or operation of the service: malware, probing or scanning for vulnerabilities, scraping, automated mass use or attempts to bypass limits.

Your content and AI results

Your files are yours. The editors process them on your own computer and we do not receive them. You are responsible for having the rights to the material you edit, upload as a reference and publish, and for the prompts you write.
Subject to these terms, you may use the results AIM Genera creates for you for any lawful purpose, including commercial use. AI results may resemble existing material or results created for other people, and are not guaranteed to be unique or to be protected by copyright.
Results are generated by AI and may be inaccurate: check them before you use them and do not present them as real when they are not. Every file says in its metadata that it was generated with AI.
Every AIM Genera request is reviewed automatically before it is created. We may refuse, block or remove any request or result that breaks these terms; refused requests are not charged.

AIM Prototype

AIM Prototype creates one-page websites and small tools from what you describe and the sketches or screenshots you upload. You may only use descriptions, sketches and screenshots that are yours or that you have permission to use, and you confirm this every time you make a request. You are responsible for what you upload and for anything you publish with the result; AIM does not verify or endorse it.
You may not use it to copy or imitate third parties' brands, logos, trade names, texts, photographs, illustrations, licensed typefaces, icons or interfaces; to make pages that impersonate another person or organisation; to make sign-in, banking, email or payment pages that pose as a real service (phishing); or to get around any access control.
What it creates is a prototype made by AI: it may contain errors and you should check it before publishing it. AIM does not host what you create: it is kept in your browser and you download it. Every request is reviewed automatically before it is created; we may refuse requests and suspend accounts that break these terms.

Reporting infringing content

If you believe that content created or shared with AIM CREATE infringes your rights, write to info@biomag.es with your contact details, the content concerned and the right you believe is infringed. We will review the report promptly and remove the content when appropriate. We suspend the accounts of people who repeatedly infringe the rights of others.

Our rights

AIM CREATE, its software, design and brand belong to BIOMAG S.L.U. or its licensors. We grant you a personal, non-exclusive, non-transferable licence to use the service under these terms; no other rights are transferred to you.

Suspension and termination

We may suspend or close an account for a material breach of these terms, non-payment, a security or fraud risk, or repeated or serious violations; when it is reasonable, we will tell you first. You can stop using the service and delete your account at any time from your account.

Availability and liability

We work to keep the service available and to make the editors reliable, but we cannot guarantee that it will be free of interruptions or errors. Keep copies of your important work. To the extent permitted by law, our liability is limited to the amount you have paid us in the last twelve months. Nothing in these terms limits the rights that consumer protection law gives you.

Changes

We may update these terms. If a change matters, we will tell you before it applies; the date of the current version appears on this page.

Law

These terms are governed by Spanish law. Disputes will be settled by the courts that are competent under the law; if you are a consumer, those of your place of residence.
